2024 LSAT—IndiaTM Candidate Agreement (Terms & Conditions)
  1. Pearson VUE is exclusively licenced to market and deliver LSAT—IndiaTM test in certain geographic areas. The terms and conditions envisaged herein (collectively, the “Agreement”) are integral to, and over and above, Pearson VUE’s privacy policy, cookie policy, other approvals, terms and conditions that may be laid down by concerned regulatory authorities, and other terms and conditions laid down by any college or university that uses LSAT—IndiaTM scores as a criterion for admission and where the Candidate (as defined hereinafter) is planning to seek admission. Notwithstanding the foregoing, each and every Candidate that registers for and/or takes the LSAT—IndiaTM agrees to comply with and adhere to the terms set forth in this Agreement and any and all policies on https://pearsonvue.excelindia.com/lsatindia (collectively, the “Policies”).
  2. Candidates applying for the LSAT—IndiaTM examination (“LSAT—India” or “test” or “exam” or “examination”), marketed, administered, scored, and operated by Pearson VUE (“Pearson VUE”) are advised to carefully read and review this Agreement and each of the Policies and thereafter complete the registration form and appear for the LSAT-India. For purposes of this Agreement, a “Candidate” shall mean any individual that completes the registration form required for an individual to take the LSAT—India.
  3. During registration for the test and prior to accessing the test, each Candidate acknowledges and agrees that he/she has read and understands this Agreement (including any and all amendments hereto that may be made prior to the Candidate appearing for the LSAT—India) and each of the Policies. Each Candidate will be provided access to the Agreement for review and acceptance at the time that the Candidate’s registers for the test. In order for the Candidate to be admitted to take the test, the Candidate must agree to be bound by this Agreement by clicking ‘I agree’ when prompted during the Candidate’s registration for the test. Any Candidate that clicks the box marked ‘I Agree’ agrees to be bound by the terms in this Agreement (including any and all amendments hereto that may be made prior to a Candidate appearing for LSAT—India) and the Policies and enters into a valid and binding contract between the Candidate and Pearson VUE relating to test.
  4. Pearson VUE is responsible for administering, operating, and scoring the LSAT—India and providing results to and on behalf of the Candidates to certain educational institutions in India. Pearson VUE is not an entity that is imparting legal education in India nor is Pearson VUE required to obtain any approvals to provide the test in India.
  5. Each Candidate is permitted to register for only one (1) instance of the test during each test administration. The dates for each LSAT—India test administration are specified in the section identified as “Key LSAT—India Dates” located on the Website (as defined hereafter). Pearson VUE reserves the right to reject duplicate and/or multiple registrations for the test during the same test administration. In the event that Pearson VUE rejects any registration from a Candidate due to duplicate and/or multiple registrations for the test during the same test administration, the Candidate shall forfeit his/her registration fee and shall not be entitled to any refund for his/her registration fees and/or any other consideration from Pearson VUE. Notwithstanding the foregoing, Pearson VUE reserves the right to cancel any test score from any Candidate that submits duplicate and/or multiple registrations for the LSAT—India during a single test administration.
  6. To help ensure that LSAT—India scores are fair and accurate for all Candidates, Pearson VUE implements a series of test-security protocols designed to prevent and/or minimize cheating and detect cheating (if cheating occurs). Each Candidate must strictly comply with and adhere to all rules relating to the LSAT-India and obey all rules and instructions on the day of the test. If Pearson VUE suspects that any Candidate is cheating or otherwise engaging in prohibited conduct related to the test, Pearson VUE will perform an investigation into the conduct of such Candidate. If following investigation into the Candidate’s conduct, Pearson VUE determines that the Candidate is cheating or otherwise engaging in prohibited conduct, Pearson VUE reserves the right to disqualify the Candidate from taking the test (if the Candidate has not yet taken the test) and/or discontinue the administration of the test to any Candidate and/or revoke any test score and/or refuse to score any test of the Candidate. Any Candidate found by Pearson VUE to have cheated or engaged in otherwise prohibited conduct shall not be entitled to any refund of his/her test registration fees and shall not receive a re-test or any other consideration from Pearson VUE. In order to deter cheating and to detect cheating and/or any other misconduct (if such conduct occurs), Pearson VUE and/or any other party acting on behalf of Pearson VUE may capture and record the Candidate’s image at multiple times during the test, perform facial comparison, monitor gaze detection, and perform identification validation.
  7. Test Details and Test Scheduling
  8. If the number of potential test takers permits it, the Candidate will be able to submit his/her preference for their test day and slot online through the submission of a standardized form on the Website or registration dashboard. After the Candidate submits his/her preference for the time and date of the test, the Candidate’s preference for the time and date of the test is established and cannot be changed, altered, modified or revised by the Candidate. Pearson VUE shall make reasonable efforts to satisfy the Candidate’s request for the date and time of the test; provided, however, the Candidate’s final date and time of the test shall be determined by Pearson VUE in its sole and exclusive discretion.
  9. The Candidate is not entitled to any refund of his/her registration fees in the event that Pearson VUE cannot comply with the Candidate’s request for the date and time of the test. Any Candidate that fails to attend the test at the designated time and date provided by Pearson VUE shall forfeit his/her registration fees. If the Candidate does not finalize a time and date for the Test during the applicable registration period for such test, Pearson VUE may select a time and date for the Candidate’s test at Pearson VUE’s sole discretion and any such selection by Pearson VUE shall be final and binding on the Candidate.
  10. The LSAT—India will be administered by Pearson VUE in an online record-and-review format which shall require each Candidate to take the test in his/her residence.
    1. In order for the Candidate to be able to take the test in online record-and-review format, any Candidate using a computer with a Windows operating system must satisfy following requirements: the Candidate must utilize a laptop or desktop computer configured with (i) Windows 8 (64 bit) (all editions except 'RT'); Windows 8.1 (64 bit) (all editions except 'RT'); or Windows 10 (64 bit) (excluding 'S Mode') on the computer being utilized to take the test, (ii) OS specified minimum RAM, 4 GB RAM or more, (iii) an attached or integrated camera on the computer being utilized to take the test with a minimum resolution of 640x480 @10 fps, (iv) a reliable and stable Internet connection with a speed of 3 Mbps upload and download, (v) an updated web browser (Chrome version 94 or above or Firefox version 92.0.1 or above) on the computer being utilized to take the test, (vi) 15 GB or greater of free disk space on the computer being utilized to take the test, and (vii) a display with a minimum resolution of 1024x768 in 16 bit colour. The Candidate is required to enable cookies and disable any pop-up blockers on his/her web browser on his/her computer being utilized to take the test. Windows Operating Systems must pass Genuine Windows Validation. Windows Vista, Windows XP, Windows 7, and all Linux/Unix bases operating systems are prohibited for exam delivery. Internet Explorer/Edge are prohibited. The Candidate is solely and exclusively responsible for ensuring that his/her equipment satisfies the system requirements necessary for the Candidate to take the test and Pearson VUE shall not be in any way obligated to refund any Candidate or provide any other consideration to any Candidate that is unable to take or complete the test due to such Candidate’s inability to comply with or adhere to the system requirements set forth herein.
    2. In order for the Candidate to be able to take the test in online record-and-review format, any Candidate using a computer with a MAC operating system must satisfy the following requirements: the Candidate must utilize a laptop or desktop computer configured with: (i) MAC OS Sierra (10.12.6) to Big Sur (11.5.2) (excluding beta versions), (ii) OS specified minimum RAM, 4 GB RAM or more, (iii) an attached or integrated camera on the computer being utilized to take the test with a minimum resolution of 640x480 @10 fps, (iv) a reliable and stable Internet connection with a speed of 3 Mbps upload and download, (v) an updated web browser (Safari 14.1.2 or above, Chrome 94.0.46 or above, or Firefox version 92 or above) on the computer being utilized to take the test, (vi) 15 GB or greater of free disk space on the computer being utilized to take the test, and (vii) a display with a minimum resolution of 1024x768 in 16 bit colour. The Candidate is required to enable cookies and disable any pop-up blockers on his/her web browser on his/her computer being utilized to take the test. Windows Operating Systems must pass Genuine Windows Validation. Windows Vista, Windows XP, Windows 7, and all Linux/Unix bases operating systems are prohibited for exam delivery. Internet Explorer/Edge are prohibited. The Candidate is solely and exclusively responsible for ensuring that his/her equipment satisfies the system requirements necessary for the Candidate to take the test and Pearson VUE shall not be in any way obligated to refund any Candidate or provide any other consideration to any Candidate that is unable to take or complete the test due to such Candidate’s inability to comply with or adhere to the system requirements set forth herein.
  11. Prior to the date of the test, Pearson VUE will provide each Candidate with a link to download the test application via an executable application file on the Candidate’s computer that will be used to take the test. Each Candidate is required to download and run the test application prior to the date of the test. Any failure to download and run the test application prior to the date of the test may result in the Candidate being unable to take or successfully complete the test, as the test may only be accessed via such test application.
  12. Prior to the date of the test, the Candidate is required to perform system verification to ensure that that Candidate’s equipment is capable of being utilized to take the test. The Candidate is responsible for ensuring that the Candidate performs this system verification using the same equipment that the Candidate will be using during the test. Pearson VUE shall provide to the Candidate (via email to the email address provided by the Candidate during registration for the test) instructions on how and when to perform this system verification. If the Candidate’s equipment is determined to be incapable of being utilized to take the test during the system verification process, the Candidate shall be solely obligated to secure replacement equipment and perform a second system verification on such replacement requirement prior to the due date determined by Pearson VUE to ensure that his/her replacement equipment is capable of being utilized to take the test. Any failure by the Candidate to perform the required system verification to demonstrate that his/her equipment satisfies the system requirements necessary to take the test by the deadline appointed by Pearson VUE will result in disqualification of the Candidate from taking the test. In the event of disqualification as a result of the Candidate’s failure to satisfy the system requirements and/or perform the appropriate system verification in the timeframes required by Pearson VUE, the Candidate shall not be entitled to any refunds or other consideration from Pearson VUE due to such failure(s).
  13. The test is comprised of four sections that shall be scored by Pearson VUE. The sections of the test may appear in any order; provided, however, the test shall contain: (a) two (2) scored sections of Logical Reasoning questions, (b) one (1) scored section of Analytical Reasoning questions, and (c) one (1) scored section of Reading Comprehension questions. The time allotted for each section is thirty-five (35) minutes (without any time allotted for a break except breaks permitted in accordance with Sections 43-44 below). Each question shall be provided in a multiple-choice format. The Candidate shall select his/her respective answer by clicking the radio button on the test screen next to the answer that the Candidate determines is appropriate.
  14. Registration
  15. Candidates must register online for the LSAT—India at the pearsonvue.excelindia.com/lsatindia (the “Website”). Each Candidate is required to register during the registration window provided on the "Key LSAT—India Dates" page of the Website for the applicable test administration. Pearson VUE will not accept any Candidate registration provided in any other mode or form.
  16. By registering for the test, the Candidate agrees to take the test in one of the following countries: (i) India, (ii) Bangladesh, (iii) Nepal, (iv) Bhutan, (v) Pakistan, (vi) Maldives, (vii) Sri Lanka, (viii) Saudi Arabia, (ix) United Arab Emirates, (x) Kuwait, (xi) Oman, (xii) Singapore, (xiii) Indonesia (xiv) Malaysia (xv) Tanzania, (xvi) Qatar or (xvii) Bahrain; provided, further, that if the Candidate will be taking the test in any of the countries referenced above in subsections (ii)-(xiv) in this paragraph, the Candidate agrees to obtain Pearson VUE’s prior written consent to test in such country at least one (1) month prior to the date of the applicable test. Please submit your request for consent to test in any country referenced in subsections (ii)-(xiv) to: lsatindia@pearson.com.
  17. Pearson VUE shall send confirmation of the Candidate’s registration and acceptance of the Candidate’s payment of the registration fees to the Candidate via email to the email address provided by the Candidate to Pearson VUE during the Candidate’s registration for the test. Pearson VUE is not responsible for the failure to deliver confirmation of registration or acceptance of payment to the Candidate as a result of any error or omission by the Candidate when entering his/her email information during the registration process.
  18. In its sole discretion, Pearson VUE may reject any registration forms that: (a) are received without payment of the total amount of the registration fee, (b) contain insufficient or incorrect details, or (c) are received by Pearson VUE after the specified closing time and date for the applicable registration. In the event that Pearson VUE rejects any registration form for any of the reasons set forth above, Pearson VUE will not entertain any queries with respect to such registration forms.
  19. Each Candidate is solely responsible for ensuring that any and all information submitted by the Candidate to Pearson VUE to take the test is true, correct, and complete in all respects. If Pearson VUE determines that any information submitted by the Candidate to Pearson VUE is false, incorrect, or incomplete in any respect, Pearson VUE, in its sole discretion, reserves the right to prevent the Candidate from taking the test and/or cancel the test score and inform the institution(s) receiving such a test score from Pearson VUE of such cancellation and the basis for such cancellation. In the event of the cancellation of the score due to false, incorrect, or incomplete information submitted by the Candidate to Pearson VUE, the Candidate shall not be entitled to any refund of his/her registration fees and/or any other consideration from Pearson VUE.
  20. Each Candidate is required to upload his/her photograph as per the specifications provided on the Website at the time of registration. Any Candidate that fails to upload a photograph that Pearson VUE determines is sufficient to authenticate the identity of such Candidate (or otherwise fails to adhere to any specifications provided on the Website) will not be permitted to access or take the test and shall not be entitled to any refund of his/her registration fees and/or any other consideration from Pearson VUE.
  21. Each Candidate must upload a legible photo, scan, or other electronic copy of an acceptable form of photograph identification. The Candidate will not be permitted to take the test and will not be offered a refund of his/her registration fees (or any other form of consideration) if any of the following occurs with respect to the Candidate:
    1. The Candidate is unable to submit valid acceptable form of photograph identification by the due date announced/communicated by Pearson VUE. The photograph identification must be unexpired, valid, and authentic and cannot require Pearson VUE (or a third party working on behalf of Pearson VUE) to input any password or remove any other type of protection to review the photograph identification; or
    2. The Candidate is unable to provide a valid acceptable form of photograph identification (unexpired, valid, and authentic) with the first and last name on the identification being identical to the first and the last names entered in such Candidate’s registration form.
  22. Pearson VUE does not and will not accept any registration for the test in any format other than as specifically provided for in this Agreement. Each Candidate is required to follow the registration process provided on the Website.
  23. Each Candidate is responsible for verifying the information submitted by the Candidate in his/her online registration form. Following submission of the Candidate’s registration form, the Candidate shall not be allowed to make any changes to the information provided by the Candidate to Pearson VUE during the registration process.
  24. Pearson VUE will not accept a Candidate’s registration form to take the test without receipt of total payment of the Candidate’s registration fees. In addition to receipt of the total payment of the Candidate’s registration fees, Pearson VUE shall not consider any registration form to be “complete” without the Candidate’s submission of the necessary photograph identification, documents, and other required information as specified on the Website, on or before the date set forth on the “Key LSAT—India Dates” for providing such information on the Website or communicated to the candidate. Any failure by the Candidate to pay the total amount of his/her registration fees and/or submit any required photograph identification, documentation, and/or other required information as specified on the Website, shall be deemed sufficient grounds for Pearson VUE to reject the Candidate’s application and Pearson VUE shall not be obligated to entertain any queries with respect to the same.
  25. Registration Fees
  26. Candidates may submit payment of the registration fees for the test through the Website using any of the payment methods permitted therein. To ascertain the latest date that Pearson VUE will accept payment of the registration fees for the applicable test, Candidates must review the "Key LSAT—India Dates" on the Website for the deadlines applicable to the Candidate for payment of the registration fees. Any submission of payment of the registration fees via any method not specifically authorized on the Website will not be accepted by Pearson VUE.
  27. Pearson VUE is not in any way responsible for the delivery or the failure to deliver any materials or information sent by Pearson VUE (or a third party working on behalf of Pearson VUE) to the Candidate sent via electronic mail.
  28. Pearson VUE may prohibit the Candidate from taking the test or may elect not to release any test score relating to the Candidate if Pearson VUE does not receive total payment of the registration fees from the Candidate.
  29. Refund of registration fee
  30. Pearson VUE will not refund any registration fees paid by the Candidate to Pearson VUE for any reason other than the reasons specifically set forth in this Agreement.
  31. It is the Candidate’s sole responsibility to review and understand the eligibility requirements of the academic institutions to which he/she is applying before determining whether the Candidate wishes to register for the test. If the Candidate registers for the test and subsequently determines that he/she is ineligible for admission to the academic institution of his/her choice, the Candidate shall not be entitled to any refund of the Candidate’s registration fees for the Test. For eligibility requirements of law schools, colleges or universities that will accept the test for admission (collectively, “Institutions”), please visit the respective websites of the applicable institutions.
  32. Notwithstanding the foregoing, the Candidate shall not be entitled to any refund of his/her registration fees or any other consideration from Pearson VUE if any of the following circumstances arise or occur:
    1. the Candidate fails to appear for a scheduled test;
    2. the Candidate attempts to take the test in presence of others like in a cyber café, library, or any other public place;
    3. the Candidate fails to submit a valid, legible electronic copy of an acceptable form of photographic identification within the applicable timeframes determined by Pearson VUE;
    4. the Candidate violates this Agreement, the Policies, or any other test rules and policies published on the Website;
    5. the Candidate does not arrive within the applicable time period established for the Candidate’s test;
    6. the Candidate submits multiple or duplicate registration forms for a single test administration;
    7. the Candidate provides false, incomplete, incorrect or misleading information and/or documents to Pearson VUE;
    8. the Candidate is unable to take or complete the test as a result of technical faults/errors during a re-test;
    9. the Candidate engages in cheating, malpractice, or other prohibited conduct; and/or
    10. the Candidate’s scores are cancelled by Pearson VUE as a result of the Candidate’s misconduct or any other reason that Pearson VUE determines is appropriate for cancellation in Pearson VUE’s sole discretion.
  33. Candidate understands and agrees that Pearson VUE, in its sole discretion, may alter, revise, modify or change the date of a test or any test administration. In the event that Pearson VUE alters, revises, modifies or changes the date of a test or any test administration, the Candidate shall not be entitled to any refund or any other consideration from Pearson VUE as a result of such alteration, revision, modification or change to the date of the test or any test administration.
  34. Notwithstanding anything to the contrary in this Agreement or otherwise, Pearson VUE, in its sole discretion, may determine that any Candidate is unable to take the test or cancel any Candidate’s test score and / or reject the registration of any Candidate to take the test. Any decision by Pearson VUE related to the foregoing shall be final and binding on the Candidates. In the event of any such determination by Pearson VUE that any Candidate is unable to take the test or that Pearson VUE shall cancel of the test score of any Candidate or that Pearson VUE shall reject registration of a Candidate to take the test, Pearson VUE shall, in its sole discretion, determine whether such Candidate is entitled to any refund of such Candidate’s registration fees and/or other consideration.
  35. Retests
  36. Any Candidate that satisfies the equipment system requirements necessary to take the test and successfully completes the system verification required for the Test, but is unable to complete the test due to technical faults during the test (e.g., computer malfunction or internet failure in the region in which the Candidate is taking the test), is eligible for one (1) re-test without being required to pay any additional registration fees for such re-test. For test administrations with more than one testing day, Pearson VUE may schedule the re-test for a subsequent testing day during such test administration or during a subsequent test administration. For test administrations with a single testing day, Pearson VUE may schedule the re-test to occur during a subsequent test administration. Any re-test provided to any Candidate shall be solely provided in the record-and-review test format. If the Candidate incurs similar or other technical faults during such re-test, the Candidate shall not be entitled to any additional re-test opportunities and shall not be entitled to any refund or any other consideration as a result of such technical faults arising during the re-test.
  37. If the Candidate is unable to complete the test due to a technical fault and wishes to take a re-test, the Candidate must submit a re-test request to Pearson VUE within twenty-four (24) hours of their original test start time. The re-test request process shall be made available to the Candidate via the Website. In order to receive a re-test, Pearson VUE, in its sole discretion, may require the Candidate to submit additional documentation deemed appropriate by Pearson VUE. The nature and amount of the documentation required from the Candidate for Pearson VUE to approve a re-test is solely within Pearson VUE’s discretion. Any Candidate that fails to submit the re-test request form or the supporting documentation within the specified time will not be entitled to a re-test without a repayment of the registration fees. Pearson VUE shall determine the date and time for the test in its sole discretion.
  38. Any sustained or significant gap/inconsistency in the photographic record obtained from the Candidate’s web camera (black, blank, or unreadable images) during the test is grounds for cancellation of the test score at Pearson VUE’s discretion. In the event of such cancellation of the Candidate’s test score due to a gap/inconsistency in the photographic record, the Candidate shall not be entitled to a refund of registration fees or any other consideration from Pearson VUE, even if such gap/inconsistency in the photographic record is not caused by any act or omission of the Candidate; provided, however, Pearson VUE may elect to provide the Candidate with a re-test at Pearson VUE’s sole discretion.
  39. Accessing Test Information
  40. Upon the date specified on the Website under "Key LSAT—India Dates" for such Candidate, each Candidate will be able to access information related to his/her test, including his/her test, system verification instructions, instructions for downloading the test application executable file, and instructions for obtaining his/her login credentials for the test. Pearson VUE may post additional instructions, rules, and policies on the Website. The Candidate shall be responsible for reviewing and understanding any and all materials, information, instructions, rules and policies posted on the Website before, during, and after the test.
  41. Pearson VUE is not responsible for or liable to any Candidate that does not or is unable to access the materials, information, instructions, rules and policies referenced in Section 34 of this Agreement as a result of incorrect information and/or documents provided by the Candidate to Pearson VUE. Pearson VUE is not responsible for or liable to the Candidate for the inability of the Candidate to access any of the materials, information, instructions, rules and policies referenced in Section 34 of this Agreement as a result of any force majeure event or other events outside of Pearson VUE’s reasonable control. If the Candidate is unable to access any or all of the materials, information, instructions, rules and/or policies referenced in Section 34 of this Agreement, then it shall be the Candidate’s responsibility and obligations to contact Pearson VUE for assistance at the Pearson VUE support desk identified on the Website.
  42. Applicants with disabilities
  43. Pearson VUE is committed to complying with the Rights of Persons with Disabilities Act, 2016 and the rules, regulations and guidelines issued thereunder, including the Guidelines for conducting written examination for Persons with Benchmark Disabilities, issued by the Department of Empowerment of Persons with Disabilities (Divyangjan), Ministry of Social Justice & Empowerment, Government of India, by way of the Office Memorandum bearing reference no. F.No.34-02/2015-dd-III, for Candidates with documented proof of impairment(s).
  44. Candidates in need of special accommodations to take the test are required to perform the following actions to receive special accommodations from Pearson VUE for the test: (a) during registration for the test, the Candidate must provide details of the Candidate’s special accommodation in the Candidate’s online application, and (b) the Candidate must scan and upload the Candidate’s disability certificate to the Website. After the Candidate provides the information described in subsections (a) and (b) above in his/her registration form, Pearson VUE will either accept or reject the Candidate’s request for special accommodations. The Candidate agrees to be bound by Pearson VUE’s decision to accept or reject the Candidate’s request for special accommodations for taking the test.
  45. Based on the Candidate’s request and compliance with the terms set forth in Sections 36 and 37 of this Agreement, the Candidate may be approved by Pearson VUE to use a scribe, reader, or assistant. Pearson VUE is not obligated and will not provide the Candidate with any scribe, reader, or assistant on the date of the test.
  46. Any Candidate approved by Pearson VUE to use a scribe, reader, or assistant or that is approved to receive additional time to take the test by Pearson VUE, will receive one (1) hour of additional time to take the test. For any such Candidate receiving additional time to take the test, the testing time for each test section shall be increased to an amount of fifty (50) minutes per section and the total time for the test shall be two hundred (200) minutes.
  47. Any application submitted by any Candidate will be reviewed by Pearson VUE on a case-to-case basis. Pearson VUE shall contact any Candidate that is approved for special accommodations to ensure that such Candidate receives the appropriate special accommodations to take the test. If Pearson VUE, in its sole discretion, subsequently determines that the Candidate failed to satisfy any of the eligibility criteria for a special accommodation request or suppressed material facts when requesting a special accommodation from Pearson VUE, the Candidate’s registration and test score will be cancelled (irrespective of the result of the test) and such Candidate shall forfeit his/her registration fees and shall not be entitled to any refund or any other consideration from Pearson VUE.
  48. Pearson VUE reserves the right to make the final determination as to whether any Candidate is entitled to special accommodations for the test.
  49. Any Candidate that provides a false, misleading, incomplete or otherwise fraudulent disability certificate shall be barred from taking the test and any registration fees paid by such Candidate shall be forfeited and such Candidate shall not be entitled to any refunds of any registration fees or any other consideration from Pearson VUE. To protect the integrity and fairness of the test, Pearson VUE, in its sole discretion, may file a complaint regarding the Candidate to any authority that Pearson VUE deems appropriate.
  50. Breaks as an Accommodation and Unauthorized Breaks
  51. Any Candidate that is approved by Pearson VUE for an accommodation based on their disability is entitled to a 5-minute section break at the end of each section of the test. Any Candidate that is approved for an accommodation based on their disability will be permitted to leave the view of such Candidate’s computer camera view for the purpose of traveling to and from the restroom during this 5-minute section break. During any section break, the Candidate understands and agrees that any scratch paper or other test-related materials must remain in the Candidate’s workspace and in view of the Candidate’s computer camera view. Any Candidate that TAKES ANY SECTION break FROM THE TEST is strictly prohibited from working on the test during such SECTION break FROM THE TEST.
  52. Any Candidate that is not approved for an accommodation is strictly prohibited from being outside of the view of such Candidate’s computer camera view during the test. If the Candidate takes an unauthorized break from the test, the clock for such Candidate’s test shall continue without interruption and such Candidate shall not receive any additional testing time to account for such unauthorized break. Any Candidate that takes an unauthorized break during the test understands and agrees that an incident report will be filed and sent to Pearson VUE indicating that the Candidate received an unauthorized break from the test and the Candidate’s test will be subject to further review by Pearson VUE. If Pearson VUE reasonably determines that the Candidate engaged in misconduct or otherwise violated any of the terms and conditions set forth in this Agreement as a result of taking an unauthorized break, Pearson VUE reserves the right to issue a finding of misconduct or cancel such Candidate’s test score.
  53. Score reporting to Candidates
  54. Pearson VUE will make reasonable efforts to provide the test results to the Candidate within four (4) weeks of the final test date for the applicable test administration (or such other time period determined by Pearson VUE) during which such Candidate takes the test. Pearson VUE will make the test results available on the Candidate’s registration dashboard. The Candidate shall be able to download the Candidate’s score card (which shall contain the Candidate’s test score) for a period of six (6) weeks following the date that Pearson VUE makes the Candidate’s test results available to the Candidate on the registration dashboard. If the Candidate wishes to access his/her score card after the period of time in which Pearson VUE makes the score cards available to such Candidate, the Candidate shall send an email request to Pearson VUE for an additional posting of the score card to the contact address on the Website, and Pearson VUE may make such score card available to the Candidate subject to the Candidate’s payment of an additional fee to Pearson VUE. Pearson VUE shall inform the Candidate of the amount of the additional fee for the request for the score card at the time the Candidate submits such request.
  55. Day of the test
  56. Each Candidate is required to be present for their respective test no later than their respective test time.
  57. During the test, each Candidate is permitted to possess the following materials: pencils, sharpeners, erasers, a clear container that may hold a single beverage, and no more than two (2) single sheets of unmarked paper for scratch work.
  58. Each Candidate is permitted to wear insertable foam ear plugs; provided, however, each Candidate is explicitly prohibited from wearing any headphones, earphones, or any other similar device that covers either or both ears of the Candidate.
  59. After the Candidate enters his/her login credentials at the time of his/her test, the Candidate is required to take a photograph of himself/herself using the Candidate’s web camera. The Candidate shall not take such photograph unless and until prompted to do so during the test by the test application software.
  60. After the Candidate’s photograph identification, registration photograph, and test day photograph of the Candidate are approved and the proctor completes the other necessary check-in procedures for such Candidate, the proctor shall initiate the Candidate’s test.
  61. Except as set forth in Sections 43-44 of this Agreement, the Candidate shall not be permitted to take any breaks during the test.
  62. Each Candidate must adhere to and comply with all of Pearson VUE’s Policies, rules, regulations, directions and/or instructions at all times before, during, and following the Test.
  63. At the proctor’s discretion, the proctor shall have the right to exclude any Candidate that fails to adhere to or comply with any of Pearson VUE’s Policies, rules, regulations, directions or instructions from sitting for, taking and/or completing the test. The proctor’s decision to exclude any Candidate from sitting for, taking and/or completing the test shall be final and binding on the Candidate.
  64. Prohibited items
  65. Commencing with the check-in period for the test and continuing until the completion of the test (as determined by Pearson VUE), the Candidate is prohibited from having, possessing, or otherwise using any mobile phones, electronic devices (with the exception of the computer being used by the Candidate to take the test), cameras, headphones, earphones, smart watches, beepers, calculators, notes, notebooks, dictionaries, arms, or any other materials not specifically authorized in this Agreement on the Candidate’s “workspace.” For purposes of this Agreement, the Candidate’s “workspace” shall be defined as the Candidate’s desk, table, work surface and the area within an arm’s reach of the Candidate’s location when the Candidate is taking the test. During testing period, the Candidate shall only be permitted to possess or utilize the materials identified in Sections 48-49 of this Agreement in the Candidate’s workspace. Accessing any prohibited item at any time during the test (commencing with the check-in period for the test) will be grounds for cancelling the Candidate’s test score. In the event of cancellation of the Candidate’s test score, the Candidate shall not be entitled to any refund of his/her registration fees and/or any other consideration from Pearson VUE.
  66. Misconduct
  67. Any individual that attempts to impersonate any Candidate, cheat or any other “examination misconduct/malpractice” (or by any other means), bring or use any prohibited item into the Candidate’s work space, or that engages or indulges in any other behavior during the test determined by Pearson VUE to be misconduct and/or malpractice may be subject to revocation of the affected Candidate’s test scores and may result in legal action against such affected Candidate. Detection of any such malpractice and/or misconduct at any stage (including any such malpractice and/or misconduct following the completion of the test) may result in the disqualification of the Candidate and revocation of such Candidate’s test scores by Pearson VUE. If Pearson VUE disqualifies any Candidate or revokes any Candidate’s test scores as a result of the conduct described in Section 57 of this Agreement, then the Candidate shall forfeit his/her registration fees and shall not be entitled to any additional consideration from Pearson VUE for such disqualification and/or revocation.
  68. The sanctity, integrity and fairness of test is of utmost importance for Pearson VUE and its Candidates. Candidates understand and agree that any act or omission by the Candidate, which would, at Pearson VUE’s sole discretion, adversely affect, compromise or jeopardize the sanctity, integrity, and/or fairness of the test will be considered misconduct. Without any prejudice to the generality of the above, any Candidate engaging in any of the following acts or omissions will be considered to have engaged in misconduct for purposes of the test:
    1. any contributing, receiving, disclosing, discussing, accessing, sharing, disseminating and/or putting in the public domain (in whatsoever form or capacity), whether directly or indirectly, any LSAT-India content or materials, the copyrighted and confidential material of Pearson VUE or its affiliates, including test questions and unpublished questions of previous years, while being a participant/member (active or passive) of, or being otherwise associated with, any platform or group, including but not limited to Telegram, Google Docs, WhatsApp, Twitter, Coursera, YouTube, Facebook, Yahoo Groups, LinkedIn and all other online chatrooms, blogs, chatgroups, etc.;
    2. any creating, contributing, disclosing, receiving, sharing, discussing, disseminating and/or accessing documents or files, containing any LSAT-India content or materials, the copyrighted and confidential material of Pearson VUE or its affiliates, including test questions and unpublished questions of tests from previous years, on any platform, including through Telegram, WhatsApp, Google Docs etc.; or otherwise discussing or disclosing directly or indirectly any test content (including the copyrighted and confidential material of Pearson VUE or its affiliates) via text message, e-mail, in any internet “chat room”, message board, or other forum; or otherwise participating in or becoming a member of any such group found to be indulging in such objectionable practices, whether over a physical medium or over the internet/ telecommunications medium;
    3. any use of a mobile phone or any other electronic device aside from the computer used by the Candidate to take the test;
    4. any communication with any individual or entity during the test except for Pearson VUE’s support staff for the purpose of addressing a technical problem incurred by such Candidate;
    5. any talking or appearing to talk during the test;
    6. except as specifically permitted under Sections 43-44 of this Agreement, any leaving of the Candidate’s seat for any purpose during the test;
    7. any usage or attempt to use any software application aside from the test application during the test;
    8. any access or usage of any prohibited items during the test;
    9. any copying or attempting to copy the test materials or capturing, recording, or photographing or attempt to capture, record, or photograph the testing computer screen by any means during the test;
    10. any connecting or disconnecting of any external storage devices from the testing computer during the test;
    11. any permitting of any other person or entity (aside from a proctor or person explicitly permitted by Pearson VUE) to access the testing computer or otherwise capture any images of the testing computer or testing material during the test;
    12. any disconnecting of the web camera or reversing/altering/modifying the view of the web camera of the testing computer during the test;
    13. taking or attempting to take the test in a cyber café, library, or any other Public location;
    14. any movement by the Candidate that results in the Candidate being outside the web camera’s view of the testing computer during the test;
    15. taking or attempting to take the test in the presence of any other person or Candidate; and/or
    16. any other act or omission by the Candidate that Pearson VUE deems to be misconduct at Pearson VUE sole discretion.
  69. If at any stage, the Candidate is found to have indulged in any misconduct, including but not limited to malpractice, cheating, unethical behavior or violation or breach of the Agreement, Pearson VUE, at its sole discretion, reserves the right to initiate appropriate actions and sanctions against such Candidate, which may include, but not be limited to, one or more of the following:
    1. revocation of test scores of Candidates (including interim suspension and/or withholding of the test scores of the Candidate);
    2. notification to the Institutions of the Candidate’s misconduct;
    3. disqualification of the Candidate for future tests;
    4. forfeiture of the Candidate’s registration fee and any other consideration from Pearson VUE including, but not limited to, the Candidate’s ability to receive a re-test; and
    5. initiation of any other proceeding(s) or action(s) against such Candidates that are available under applicable law including but not limited to actions/prosecutions under the applicable laws for injunction and/or damages.
    Any finding by Pearson VUE of Candidate misconduct shall be final and binding upon the Candidate.
  70. Candidate's Undertakings
  71. The Candidate hereby irrevocably agrees and accepts the following obligations of the Candidate for the test:
    1. LSAT—India is a separate and distinct examination from the LSAT® and does not have any bearing on the LSAT® examination for securing admissions to foreign universities. The LSAT—India is designed to cater to the requirements of the Institutions that agree to adopt the LSAT—India as an admissions criterion for their respective Institution. LSAT—India should not be directly or indirectly equated to LSAT. The scores obtained by a Candidate on the LSAT—India will have no relevance for admission to any foreign institution outside of India or any institution in India that is not defined as an Institution for purposes of this Agreement.
    2. The eligibility standards for admission to Institutions are determined solely by each of the respective Institutions and is not determined in any way by Pearson VUE. Each Candidate is responsible for confirming that any institution that he/she wishes to attend will accept the test scores as a criterion for admission to such institution.
    3. Pearson VUE is responsible for administering, operating, and scoring the test. Pearson VUE is not and will not be responsible for obtaining the requisite approvals, consents, or permissions of the concerned regulatory authorities for the Institution for conducting the relevant course. It shall be the Candidate’s sole responsibility for ascertaining from the concerned Institution whether such Institution obtains the requisite approvals, consents, or permissions of the concerned regulatory authorities for the education Institution for conducting the relevant course.
    4. Candidate will not hold Pearson VUE or its affiliates liable or accountable for any issues relating to admission to any Institution for which the exam is being conducted.
    5. Candidate agrees to adhere to and comply with any and all policies relating to the Website.
    6. Candidate will not share, disseminate, contribute, receive, disclose, discuss, access, copy, transfer, transmit and/or put in the public domain any of the preparation material for the test, or any of the copyrighted materials relating to the test, whether in electronic or hard copy format.
    7. Any and all information and documents provided by the Candidate to Pearson VUE are true, accurate, complete, and are not misleading.
  72. Disclaimer
  73. Any links provided to third party websites, or information supplied about third parties (third party information) on the Website is supplied as a convenience. Linked sites are not under the control of Pearson VUE; and Pearson VUE is not responsible for any third party linked sites, the contents of such sites, any use of the same, or for third party information. The inclusion of a link or third party information does not imply endorsement by Pearson VUE of the linked site or third party information, any organization or person associated with the linked site or third party information, or any products or services offered or marketed through the linked site or by the third party.
  74. Collection, Handling and Transfer of Information
  75. By registering for the test, the Candidate gives their express consent for their personal information (with the exception of the debit/credit card and other financial information) to be collected, stored, handled and transmitted by, Pearson VUE (and/or its affiliates) and/or any other party acting on behalf of Pearson VUE (and/or its affiliates) to Pearson VUE and/or its affiliates and/or to any other party acting on behalf of Pearson VUE (and/or its affiliates):
    1. and to Institutions;
    2. for the purpose of enabling the Candidates to successfully register for the test; and/or
    3. for making requisite arrangements for the Candidates to take the test.
  76. By registering for test, the Candidate also gives their express consent for the capturing, recording, collecting, storing, handling and transmitting of the Candidate’s photographs during the test; and for performing a facial comparison, monitoring gaze detection, identification validation and automatic processing of their information by Pearson VUE (and/or its affiliates) and/or any other party acting on behalf of Pearson VUE (and/or its affiliates). This information is collected, stored, and transmitted:
    1. so that the Candidate can be registered and assigned a test date,
    2. so that the Candidate can appear for the test,
    3. to ensure that no misconduct and/or malpractice takes place during the test,
    4. to investigate/detect any misconduct and/or malpractice that might be reasonably suspected to have happened during the test
    5. to have the Candidate’s test scored, and
    6. for the Candidate to receive a test score card.
  77. The Candidate’s test score and other personal information as set out above or otherwise (with the exception of the debit/credit card and other financial information and Candidate photographs obtained during the test) may be transmitted to certain educational institutions.
  78. Other Transfer of Information
  79. In addition to transmitting certain personal information about the Candidate by Pearson VUE and other parties as set out above, Pearson VUE may disclose personally identifiable information in the following situations:
    1. In response to a subpoena, court order, or legal process, to the extent permitted and required by law;
    2. To protect Candidate security or the security of other persons, consistent with applicable law;
    3. To address actual or suspected fraud or other illegal activities;
    4. In connection with a sale, joint venture, or other transfer of some or all of the assets of the company;
    5. To our licensors and service providers for the purpose of assessing compliance with our existing agreements with such licensors and service providers; and
    6. To our contractors or agents, including those who are committed or obliged to protect your privacy in a manner consistent with the Pearson VUE’s privacy policy.
  80. For purposes of validating test and user integrity and security, Pearson VUE and/or its affiliates may take photographs and video recordings of Candidates during the test. Further, the Candidate acknowledges that such photographs and may also be used by Pearson VUE (and/or its affiliates) and/or any other party acting on behalf of Pearson VUE (and/or its affiliates) to ensure that there has been no misconduct or malpractice by the Candidate during the test. By registering for the test, the Candidate gives their consent for transmission of personal information in situations outlined in Sections 61, 62, 63, 64, 65, 66 and elsewhere in this Agreement.
  81. Information received from Internet Service Providers through the Website
  82. This Website receives information that is automatically generated by a user's Internet service provider (ISP). This information may include the IP address (a number automatically assigned to a computer by the ISP), the associated URLs, domain types, the browser type used to access the Website, the country, state and telephone area code, the location of the ISP's servers, the pages of the Website that the user views, any search terms entered on this site, and the user's website address and email address. This information may be collected for system administration purposes, to gather broad demographic information and to monitor the level of activity on the site. Pearson VUE does not link IP addresses to personally identifiable information; however, reserves the right to link IP addresses and other information supplied by the ISP to personally identifiable information in order to protect the integrity of its system and for security purposes.
  83. Pearson VUE describes in its privacy policy, the details and policies concerning collection, storage, use, disclosure and transfer, retention and security concerning Candidate information. Candidate agrees that they have read and reviewed the entire privacy policy (available on the Website) before registering for the test. Candidate understands that by accepting this Agreement, they are providing express consent for the collection, storage, use disclosure and transfer of their information, as set out under the privacy policy.
  84. Governing Law and Jurisdiction
  85. This Agreement shall be governed by and construed in accordance with the laws of India, without effect to any principles of conflict of laws.
  86. Subject to the provisions relating to Dispute Resolution below, all disputes and differences of any kind whatsoever arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts at New Delhi only, to the exclusion of all other courts/legal fora.
  87. Dispute Resolution
  88. Any and all disputes and/or differences that may arise as between a Candidate and Pearson VUE arising out of or in connection with or in relation to the test and/or the Agreement shall be exclusively submitted to arbitration under the Arbitration and Conciliation Act, 1996, as applicable, and shall be adjudicated by an arbitral tribunal comprising a sole arbitrator to be appointed by mutual consent of the parties. The arbitration shall be conducted in English language and the decision of the arbitral tribunal shall be final and binding on the parties. The seat of arbitration shall be New Delhi.
  89. Notices
  90. Any notice or other communication to Pearson VUE shall be provided in writing at the email address mentioned on the Website. In case of any complaints to be submitted to Pearson VUE, Candidates may write to the email address mentioned on the Website. Any notice and communication to Candidate shall be made on the email address provided by the Candidate at the time of registration for the test.
  91. Amendments to the Agreement
  92. Pearson VUE reserves the right to make amendments to the Agreement at any time. It is the Candidate’s responsibility to read the Agreement and check for amendments on a regular basis. The amended Agreement will be set out on the registration site and Website for perusal and will also be communicated to Candidate on their registered email as at the time of such amendments. The amendments to the Agreement become effective no sooner than twenty-four (24) hours after they are set out on the Website. However, amendments made for any legal or regulatory reasons will be effective immediately.
  93. Limitation of Liability
  94. LIMITATION OF LIABILITY AND DAMAGES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, Pearson VUE’S TOTAL LIABILITY TO THE CANDIDATE, OR ANYONE CLAIMING BY OR THROUGH THE CANDIDATE OR ON THE CANDIDATE’S BEHALF, FOR ANY CLAIMS, LOSSES, COSTS, OR DAMAGES ARISING OUT OF, RESULTING FROM, OR IN ANY WAY RELATED TO THE TEST, FROM ANY CAUSE, SHALL NOT EXCEED THE TEST REGISTRATION FEES THE CANDIDATE PAID TO Pearson VUE. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEARSON VUE BE LIABLE TO THE CANDIDATE, OR ANYONE CLAIMING BY OR THROUGH THE CANDIDATE OR ON THE CANDIDATE’S BEHALF, FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, SPECULATIVE, INCIDENTAL (including any damages INCURRED DUE TO A losS OF opportunity, income, or profits; loss of information; business interruption; travel AND LODGING expenses; test-preparation course fees; or the like, REGARDLESS OF WHETHER OR HOW THESE ARE CLASSIFIED AS DAMAGES), EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ATTORNEYS’ FEES, EXPENSES, EXPERT WITNESS FEES, OR COSTS, WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, OR OTHERWISE AND REGARDLESS OF WHETHER SUCH LOSS OR DAMAGE WAS FORESEEABLE OR THE CANDIDATE AND/OR Pearson VUE HAVING BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.
  95. Severability
  96. If any provision of the Agreement is deemed invalid, void, or for any reason unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining terms of the Agreement.
  97. Intellectual Property Rights. The test, test-related documents and materials, and test preparation materials are copyrighted works owned by/licenced to Pearson VUE. Secure tests and test questions, including, but not limited, to any tests and test questions that are not made publicly available may not be copied, shared, discussed, or disclosed at any time or in any manner whatsoever. Test-related materials that have been made available to the general public, such as materials designated as practice or sample tests, may not be copied, duplicated, or used in any other works, in whole or in part.
    1. Consequences for Violation of Pearson VUE’s Rights: Pearson VUE may pursue all available civil and criminal remedies if their intellectual property rights are violated, including seeking damages and injunctive relief in a court of law and referring such violations to law enforcement authorities for criminal prosecution. Pearson VUE reserves the right to pursue all suitable courses of action to prevent fraudulent or unauthorized use, disclosure, copying, misappropriation, or sharing of its property and to prevent the compromise of secure test materials.
    2. Pearson VUE Intellectual Property rights of Test Materials: Pearson VUE retains its intellectual property rights to the test and all test materials, including, but not limited, to the Candidate’s test answers. Pearson VUE has intellectual property rights in all answers and answer documents that the Candidate submits, including all written responses, as well as all test score-related data maintained by Pearson VUE. Test score reports that Pearson VUE provides to the Candidate may not be altered, and, if Pearson VUE cancels the test scores reflected on such test score reports, the Candidate may not provide such test scores or test score reports to any third party.
  98. Pearson VUE Policies. All Policies referenced in this Agreement, including but not limited to the Pearson VUE Privacy and cookies Policy (available at https://pearsonvue.excelindia.com/lsatindia), are incorporated by reference and made a part of this Agreement. The Policies are periodically updated and subject to change at any time, without notice. The Candidate has an obligation to read the Policies before taking the test. If you do not agree with the applicable Policies that are in effect within forty-eight (48) hours prior to your test, the Candidate is obligated to notify Pearson VUE prior to the test of Candidate’s intention to cancel the Candidate’s registration pursuant to this provision. At its sole discretion, Pearson VUE may elect to provide a refund in the event of such test cancellation.
  99. Ongoing Duty. The Candidate certifies that all the information contained in this Agreement, as well as information and materials submitted to Pearson VUE and any information the Candidate submits to any third party for purposes of taking the test, are true, complete and accurate. The Candidate understands and agrees that the Candidate is responsible for the veracity, completeness and accuracy of all the biographical information contained in this Agreement. The Candidates certifies that he/she has read the most current Policies and agrees to be bound by such Policies. The Candidate is responsible for actively managing the Candidate’s account to ensure that all relevant information is received by Pearson VUE, that all information provided to Pearson VUE is current and correct, and that all deadlines are met by the Candidate. The Candidate represents and warrants that all information provided by the Candidate to register for the test is complete, accurate, and current. Any failure by the Candidate to provide accurate and consistent information could result in errors, processing delays, file reviews and possible referral for a misconduct or irregularity investigation. Should Pearson VUE become aware of a discrepancy in the Candidate’s biographical data, the Candidate will be notified in writing and asked to provide the correct data in writing. In some instances, a reporting hold may be placed on the Candidate’s file until the matter is resolved. The Candidate might also be asked to provide documentation to support the biographical data change.
  100. No Third-Party Beneficiary. This Agreement does not create a third-party beneficiary relationship between Pearson VUE and any individual or entity other than the Candidate.
  101. No Agency. Pearson VUE collects and distributes information about the Candidate and transmits it to educational institutions in accordance with Pearson VUE’s policies. Pearson VUE also provides the Candidate with information about certain educational institutions. Pearson VUE's role in the collection and transmission of information does not mean that Pearson VUE is the Candidate’s agent or an agent of any educational institution. Pearson VUE has no authority to alter or waive any requirement of any educational institution. Any disputes between the Candidate and any educational institution must be resolved directly with the applicable educational institution.

Your continued access, use, browsing or purchasing via LSAC LawPrepsm following the posting of any modification or revision to the LSAC LawPrepsm Terms will be deemed acceptance of the modified or revised LSAC LawPrepsm Terms. To see when these LSAC LawPrepsm Terms have been last updated, please review the “Last Revised” date displayed at the top of these LSAC LawPrepsm Terms. It is your responsibility to continually review the LSAC LawPrepsm Terms to be aware of any changes or revisions to the LSAC LawPrepsm Terms. If you do not agree with the changes, you should notify us, immediately stop using LSAC LawPrepsm, and we will disable your access to the LawPrep Platform Webpage.


We often make Products & Services available to you through LSAC LawPrepsm and when we do, additional terms and conditions may apply to the Products & Services. Such additional terms will be presented to you at the time of digital access to the applicable Products & Services. Those additional terms are hereby incorporated by reference into these LSAC LawPrepsm Terms and become part of your agreement with us if you use, access, or purchase any such Products & Services (as applicable). In the event of a conflict between these LSAC LawPrepsm Terms and those additional terms, the latter will control.


1. Using THE LawPrep Platform Webpage.

LSAC LawPrepsm allows for the selection and purchase of and, in certain instances, access to our Products & Services. LSAC LawPrepsm may also provide news and valuable information about our Products & Services, including, without limitation, data, articles, publications, videos, products, graphics, photographs, video, sound, audio clips, digital downloads, text, images, icons and other material (collectively, “Content” or “Contents”).


2. LIMITED LICENSE.

Subject to the restrictions and limitations set forth in these LSAC LawPrepsm Terms, we grant you a limited, non-exclusive license to access and use LSAC LawPrepsm and certain Products & Services solely for your own personal internal use. You are permitted to use a single copy of the Products that you purchase through LSAC LawPrepsm for your personal and non-commercial use solely within the LSAC LawPrepsm platform.


3. BILLING AND PAYMENT

3.1 Payments
LSAC LawPrepsm provides certain payment options for the various Products & Services. These payment options can be found in the individual Product & Services descriptions and may change from time to time at Pearson VUE’s discretion. Once your initial payment is processed by Pearson VUE for any electronic Products & Services, you will be granted immediate access to the applicable electronic Products & Services.


3.2 Subscriptions

  1. Subscription Term. Each subscription for access to practice tests from LSAC LawPrepsm is provided for a period of six (6) months commencing on the date of your purchase and expiring six (6) months thereafter. During your 6-month subscription period, you will be permitted to take each practice test that you purchased on LSAC LawPrepsm a maximum of five (5) instances. After you have attempted to take any given practice test five (5) instances, you will no longer be permitted to access or take such practice test. Following the expiration of your 6-month subscription period, you will no longer be able to access any practice test that you purchased as part of your subscription. For purposes of these LSAC LawPrepsm Terms, any access of a practice test by you with be considered an “instance” of taking such practice test.
  2. You will have the option to purchase 6-month subscriptions for the practice tests in the following practice test series amounts set forth below. Each series of practice tests is subject to the five (5) attempt maximums set forth above in Section 3.2(a) of these LSAC LawPrepsm Terms:
    1. Silver Series 1: Three (3) practice tests: PrepTest A, PrepTest B, PrepTest C;
    2. Silver Series 2: Three (3) practice tests: PrepTest D, PrepTest E, PrepTest F;
    3. Silver Series 3: Three (3 practice tests: PrepTest G, PrepTest H, PrepTest I;
    4. Gold Series 1: Five (5) practice tests: PrepTest A, PrepTest B, PrepTest C, PrepTest D, PrepTest E;
    5. Gold Series 2: Five (5) practice tests: PrepTest F, PrepTest G, PrepTest H, Preptest I, Preptest J; and
    6. Platinum Series : Ten (10) practice tests: PrepTest A, PrepTest B, PrepTest C, PrepTest D, PrepTest E, PrepTest F, PrepTest G, PrepTest H, PrepTest I, PrepTest J.


3.3 No Refunds
Following your submission of payment for the applicable Products & Services, you will not be entitled to a refund from Pearson VUE under any circumstances including but not limited to: (a) your inability to access the Products & Services due to any failure to comply with the necessary computer system requirements; (b) your failure to submit a practice test; (c) your providing incorrect or misleading information and/ or documents; and/or (d) your failure to comply with these LSAC LawPrepsm Terms, or any other rules and policies published on the LawPrep Platform Webpage.


3.4 Additional Products & Services.
Pearson VUE is authorized to charge your credit card for any additional Products & Services for which you authorize payment for on or in the LSAC LawPrepsm Platform Webpage.


4. PROHIBITIONS ON USE.

Any reproduction of the Products & Services, Content or any portion thereof is strictly prohibited without the prior written consent of Pearson VUE. Upon accessing the LawPrepsm Platform Webpage, you understand and agree that the following activities are expressly prohibited without Pearson VUE’s prior written consent:


4.1 any non-personal or commercial use of any of the Products & Services, Content or LawPrepsm without Pearson VUE’s prior written consent. You shall not distribute or make all or any part of the Products & Services or Content available for use by another person or entity. You may not, and agree not to permit any third party to, directly or indirectly sell, rent, lease, loan, timeshare, license or sublicense any of the Products & Services, Content, or LawPrepsm;

4.2 use of any robot, spider, other automatic device or manual process to monitor or copy LawPrepsm or any of the Content;

4.3 “mirroring” LawPrepsm or any Content on any other server or device;

4.4 copying, downloading, modifying, adapting, editing, creating derivative works from, transferring, selling, licensing, renting or otherwise exploiting or making commercial use of LawPrepsm or any element thereof (including any Content, software code, data or materials used in or available on LawPrepsm);

4.5 collection or use of product listings, descriptions or prices for a supplier of competitive or comparable products;

4.6 any action that imposes an unreasonable or disproportionately large load on LawPrepsm or otherwise interferes with the functionality of LawPrepsm, the LawPrep Platform Webpage, or any of the Products & Services;

4.7 the input or upload of any information which contains viruses, Trojan horses, worms, ransomware, time bombs or other computer programming routines that are intended to damage, interfere with, intercept or expropriate any Pearson VUE system, including LawPrep Platform Webpage, LawPrepsm, any Content or any Products & Services;

4.8 deleting or altering any copyright, trademark or other proprietary rights notices from any materials accessed or accessible from LawPrepsm;

4.9 attacking LawPrepsm or LawPrep Platform Webpage via a denial-of-service attack or a distributed denial-of-service attack;

4.10 exploiting or harming minors (or attempting to do so) in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise;

4.11 procuring the sending of any advertising or promotional material (without our prior written consent), including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation; or

4.12 reverse engineering, decompiling, decrypting, disassembling or converting into human readable form, LawPrepsm or any element thereof (including any Content, Products & Services, software, code, data or materials used in or available on LawPrepsm).


You may not frame or utilize framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout or form) of Pearson VUE, without Pearson VUE’s prior written consent. You may not use any meta tags or any other “hidden text” utilizing Pearson VUE’s name or trademarks/Service Marks without Pearson VUE’s prior written consent.


In addition to the use specified herein, the LSAC LawPrepsm Terms herein apply to any other software (including any updates or upgrades to the software and any related documentation) that we make available to you from time to time for your use in connection with our Products & Services (the “Pearson VUE Software”) and terms of the software license agreement accompanying such Pearson VUE Software (the “License Agreement”), and is further conditioned on your agreement to be bound by the terms of the License Agreement.


5. PRIVACY.

5.1 We consider the privacy and protection of our customers’ and users’ personal data and personal information to be paramount. All policies referenced in the LSAC LawPrepsm Terms, including but not limited to the Pearson VUE Privacy Policy (available at https://home.pearsonvue.com/privacy), are incorporated by reference and made a part of these LSAC LawPrepsm Terms (collectively, the “Policies”). These Policies are periodically updated and may be amended, revised, or modified by Pearson VUE at any time and without notice. These Policies provide further information regarding our practices and policies in relation to personal data and personal information.

5.2 Pearson VUE reserves the right to monitor your use of the Products & Services and to collect and analyse data relating to your use of the Products & Services. This information includes, but is not limited to, information about your installation of the Products & Services (e.g., installation time, platform, version number), how you use the Products & Services (e.g., session ID, event log, session flow and navigation, error log), and performance on practice exams and test questions (e.g., test ID, questions, answers, time to answer, test score).

5.3 When you use the Products & Services, your personal information is shared with Pearson VUE, and your use of the Products may be used for comparisons with your performance on the LSAT-India. Pearson VUE may use this data for certain business purposes, which include, but are not limited to, the following purposes:

  1. to improve or remediate the Products & Services or LawPrep Platform Webpage to assist with study efforts and predictions of performance on the LSAT-India;
  2. for marketing research;
  3. to make promotional offers from Pearson VUE relating to the Products & Services;
  4. to assess your compliance with these LSAC LawPrepsm Terms; or
  5. to notify you of any changes, modifications, upgrades or add-ons to the Products & Services, LSAC LawPrepsm or the LSAC LawPrepsm Terms; or
  6. to assess our compliance with the terms of our agreements with third-party that relate to LSAC LawPrepsm, the Products & Services, Content or the LawPrep Platform Webpage.

You may opt out of receiving Pearson VUE communications at any time by sending an email to Pearson VUE at: lsatindia@pearson.com

5.4 By purchasing the Products & Services, you give your express consent for Pearson VUE and/or any third party acting on behalf of Pearson VUE to collect, store, handle, and transmit your personal information (with the exception of the debit/credit card and other financial information) to third parties, law schools, colleges, universities or other academic institutions that are allied, associated, or affiliated with LSAT-India (collectively, the “Institutions”). Notwithstanding the foregoing, Pearson VUE will not share the results of your performance on any practice test purchased on LawPrep with any third party including any Institution.

5.5 Your personal information collected, stored, handled or transmitted as set forth above (with the exception of the debit and/or credit card information and other financial information) may be transmitted to certain third parties including but not limited to Institutions.

5.6 In addition to transmitting certain personal information about you to Pearson VUE and Institutions as described above, Pearson VUE may disclose personally identifiable information in the following situations:

  1. in response to a subpoena, court order, or legal process, to the extent permitted and required by law;
  2. to protect your security or the security of other persons, consistent with applicable law;
  3. to address actual or suspected fraud or other illegal activities;
  4. for commercial activities with academic institutions and test preparation entities including the Institutions;
  5. in connection with a sale, joint venture, or other transfer of some or all of the assets of the company; and/or
  6. to our contractors or agents, who are committed or obliged to protect your privacy in a manner consistent with the Pearson VUE’s Privacy Policy.

5.7 LawPrep Platform Webpage receives information that is automatically generated by a user's Internet service provider (ISP). This information may include the IP address (a number automatically assigned to a computer by the ISP), the associated URLs, domain types, the browser type used to access the LawPrep Platform Webpage, the country, state and telephone area code, the location of the ISP's servers, the pages of the LawPrep Platform Webpage that the user views, any search terms entered on LawPrep Platform Webpage, and the user's website address and email address. This information may be collected for system administration purposes, to gather broad demographic information and to monitor the level of activity on the LawPrep Platform Webpage. Pearson VUE agrees not to link your IP addresses to your personally identifiable information; provided, however, Pearson VUE reserves the right to link your IP address and other information supplied by the ISP to your personally identifiable information in order to protect the integrity of its system and for purposes of security.


6. YOUR ACCOUNT.

To access LSAC LawPrepsm, place orders or otherwise use the Products & Services on LSAC LawPrepsm, you may be required to open an online account and/or provide certain personalized information to us (collectively, “User Information”). You agree that you are solely responsible for the accuracy and content of your User Information, and you agree that it is your exclusive obligation to keep your User Information current, accurate, complete and up-to-date. It is your exclusive obligation to maintain the confidentiality of your account, password, digital signature and User Information, and for restricting access to such information on your computer and any other electronic devices. You hereby agree to accept full responsibility for all activities that occur under your account or password on LSAC LawPrepsm, the LawPrep Platform Webpage or otherwise on any website or software owned or operated by Pearson VUE.

Any transmission of your User Information (including but not limited to your account user name and password) to allow any person or entity other than yourself to use the Products & Services or access LSAC LawPrepsm is expressly prohibited and any failure to comply with this prohibition may result in the suspension or termination of the right to continue to use the Products & Services at Pearson VUE’s discretion. You shall use your best efforts to maintain the secrecy of such User Information and shall not save such User Information on any workstation that is capable of being accessed by any third parties.


7. MISCONDUCT.

7.1 The sanctity, integrity and fairness of the Products & Services is of utmost importance for Pearson VUE. You understand and agree that any act or omission by you, which would, at Pearson VUE’s sole discretion, adversely affect, compromise or jeopardize the sanctity, integrity, and/or fairness of the Products & Services will be considered misconduct. Without any prejudice to the generality of the above, if you engage in any of the following acts or omissions, you will be considered to have engaged in misconduct:

  1. any contributing, receiving, disclosing, discussing, accessing, sharing, disseminating and/ or putting in the public domain (in whatsoever form or capacity), whether directly or indirectly, the copyrighted and confidential material of LSAC (licenced to Pearson VUE/Pearson VUE, including test questions and preparatory material (collectively, the “Proprietary Content”), while being a participant/member (active or passive) of, or being otherwise associated with, any platform or group, including but not limited to Reddit, Telegram, Google Docs, WhatsApp, Signal, Twitter, Coursera, YouTube, Facebook, Yahoo Groups, LinkedIn or any other online chatrooms – blogs, chat groups, etc.;
  2. any creating, contributing, disclosing, receiving, sharing, discussing, disseminating and/or accessing documents or files, containing the Proprietary Content, on any platform, including through Reddit, Telegram, Google Docs, WhatsApp, Signal, Twitter, Coursera, YouTube, Facebook, Yahoo Groups, LinkedIn or any other online chatrooms – blogs, chat groups, etc.; or otherwise discussing or disclosing directly or indirectly any Proprietary Content via text message; e-mail; on any message board, or other forum; or otherwise participating in or becoming a member of any such group found to be indulging in such objectionable practices, whether over a physical medium or over the internet/telecommunications medium;
  3. any permitting of any other person or entity to access your account or otherwise capture any images of the Proprietary Content; and/or
  4. any such other act or omission that is deemed to be misconduct by Pearson VUE at its sole discretion.

7.2 If at any stage, you are found to have indulged in any misconduct in violation of any terms set forth in Section 7.1 of these LSAC LawPrepsm Terms, Pearson VUE at its sole discretion reserves the right to initiate appropriate actions and sanctions against you, which may include, but not be limited to, one or more of the following:

  1. cancellation of, and revocation of access to your LSAC LawPrepsm account and any corresponding Products & Services accessible through the LawPrep Platform Webpage;
  2. disqualification for future tests of LSAT—IndiaTM;
  3. forfeiture of any amounts / fees paid by you to Pearson VUE prior to engaging in such misconduct; and/or
  4. initiation of any other proceeding(s) or action(s) against you as available under applicable law including but not limited to actions/prosecutions under the applicable laws for injunction and/or damages.

Any decision of Pearson VUE under this Section 7.2 of the LSAC LawPrepsm Terms will be final and binding upon you.


8. INTELLECTUAL PROPERTY.

As between you and Pearson VUE, Pearson VUE is the exclusive licensee of all right, title and interest in and to LSAC LawPrepsm, its Products & Services, any Content, and all elements thereof, including all the Proprietary Content, software, code, data, and materials used therein or available thereon, the look, feel and design of LSAC LawPrepsm, the compilation of the Content, code, data and materials in LSAC LawPrepsm, and all copyrights, trademark rights, patent rights, database rights, trade secrets, moral rights (including rights of authorship, attribution and subsequent modification) and other intellectual property and proprietary rights (whether registered or unregistered in any jurisdiction) in any of the foregoing. Your use of LSAC LawPrepsm or any of its Products & Services does not grant to you any right, title or interest in any element thereof, and LSAC/Pearson VUE (and/or our applicable licensors and partners) owns and retains all right, title and interest (including all intellectual property and proprietary rights) therein and thereto.

8.1 Copyright Notice.
All Pearson VUE Software and all Content on LSAC LawPrepsm are the exclusive licensed property of Pearson VUE and is protected by United States’ and international copyright laws. All Rights Reserved.


8.2 Trademark Notice.
All marks on LSAC LawPrepsm are registered trademarks of the Law School Admission Council, Inc. (“LSAC”) in the United States and/or other jurisdictions. LSAC LawPrepsm and its related graphics, logos, page headers, button icons, scripts, and product and service names included in or made available through the Products & Services, are trademarks or trade dress of LSAC in the United States and/or other jurisdictions. LSAC’s trademarks and trade dress may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits LSAC. All other trademarks not owned by LSAC that appear on LSAC LawPrepsm are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by LSAC.


8.3 Copyright & Trademark Complaints Notice.
Pearson VUE respects the intellectual property rights of third parties. Correspondingly, Pearson VUE requires all users of LSAC LawPrepsm, LawPrep Platform Webpage, and/or the Products & Services to respect Pearson VUE’s/LSAC’s intellectual property rights. If you believe that your work has been copied in any manner that infringes on your intellectual property rights, we ask you to report your alleged infringement as expeditiously as possible, to lsatindia@pearson.com.


9. YOUR UNDERTAKINGS.

9.1 By accessing LSAC LawPrepsm and/or LawPrep Platform Webpage, you irrevocably undertake and agree to the following:

  1. You agree to adhere to and comply with any and all policies relating to the LawPrep Platform Webpage;
  2. You agree not to share, disseminate, contribute, receive, disclose, discuss, access, copy, transfer, transmit with any third party and/or otherwise put into the public domain any of the preparation material of LSAC LawPrepsm, or any of the copyrighted materials relating to the LSAC LawPrepsm, whether in electronic or hard-copy format;
  3. You agree that any information and documents provided by you to Pearson VUE are true, accurate, complete, and are not misleading; and
  4. You further agree that Pearson VUE and its licensors, affiliated companies involved in delivery of LawPrepsm , and their respective officers, directors, shareholders, members, employees, attorneys, representatives, agents, assigns, content providers, service providers, suppliers and licensors (collectively, the “Pearson VUE Service Partners”) explicitly disclaim any and warranties or representations that:
    1. the LSAC LawPrepsm and/or its Products & Services will meet your requirements or expectations, including, without limitation, any improvement of your future score or performance on the LSAT-India or any other examination;
    2. your use of LSAC LawPrepsm, the LawPrep Platform Webpage, the Products & Services or any Content will be error-free, uninterrupted, timely and secure;
    3. the results obtained from your use of the Products & Services will be accurate or reliable;
    4. the quality of the Products & Services will satisfy or exceed your expectations;
    5. any information you provide or Pearson VUE Service Partners collect, generate, or store will not be disclosed; or
    6. any errors in any data, material, software or otherwise will be corrected by Pearson VUE.
10. DISCLAIMERS

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR ACCESS TO AND USE OF LSAC LawPrep IS AT YOUR SOLE RISK, AND LSAC LawPrep, THE LawPrep Platform Webpage, THE PRODUCTS & SERVICES, AND ALL CONTENT (INCLUDING LSAC LawPrep SOFTWARE OR ANY OTHER SOFTWARE), FUNCTIONS, MATERIALS AND PRODUCTS & SERVICES INCLUDED IN OR OTHERWISE MADE AVAILABLE TO YOU THROUGH LSAC LawPrep (COLLECTIVELY, “MATERIALS”) ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE MATERIALS OR ANY INFORMATION CONTAINED THEREIN.

11. LIMITATION OF LIABILITY.

IF YOU OR ANY THIRD PARTY ARE DISSATISFIED WITH ANY PORTION OF LSAC LAWPREP, THE LAWPREP PLATFORM WEBPAGE OR WITH ANY MATERIALS OR THE LSAC LAWPREP TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING LSAC LAWPREP AND MATERIALS. UNDER NO CIRCUMSTANCES SHALL ANY OF THE PEARSON VUE SERVICE PARTNERS BE LIABLE TO ANY USER OR ANY THIRD PARTY ON ACCOUNT OF THAT USER'S USE OF LSAC LAWPREP, THE LAWPREP PLATFORM WEBPAGE, OR ANY MATERIALS. IN NO EVENT SHALL PEARSON VUE OR ANY OF THE PEARSON VUE SERVICE PARTNERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, PUNITIVE, EXEMPLARY, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF LSAC LAWPREP OR THE LAWPREP PLATFORM WEBPAGE, THE DELAY OR INABILITY TO USE LSAC LAWPREP OR THE LAWPREP PLATFORM WEBPAGE, THE PROVISION OF OR FAILURE TO PROVIDE THE MATERIALS, OR THE CONTENT CONTAINED WITHIN THE MATERIALS, REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, AND EVEN IF PEARSON VUE AND THE PEARSON VUE SERVICE PARTNERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF PEARSON VUE AND THE PEARSON VUE SERVICE PARTNERS FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING FROM THESE LSAC LAWPREP TERMS OR YOUR USE OF THE PRODUCTS &SERVICES, MATERIALS OR CONTENT EXCEED, IN THE AGGREGATE, THE AMOUNT THAT YOU HAVE ACTUALLY PAID TO PEARSON VUE FOR THE PRODUCTS & SERVICES DIRECTLY RELATED TO YOUR DAMAGES, LOSSES, AND CAUSE OF ACTION REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.


12. NOTICE REGARDING ENFORCEABILITY OF CERTAIN DISCLAIMERS AND LIMITATIONS OF LIABILTY.

THE LAWS OF CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES AND/OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE DISCLAIMERS, EXCLUSIONS AND LIMITATIONS PROVIDED FOR HEREIN (INCLUDING IN SECTION 10 AND SECTION 11 ABOVE) MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

You agree not to download or use images hosted on LSAC LawPrepsm, the LawPrep Platform Webpage, or the Products & Services on another website or platform, for any purpose, including, without limitation, posting such images on another site. You agree not to link from any other website to LSAC LawPrepsm or the LawPrep Platform Webpage in any manner such that LSAC LawPrepsm or the LawPrep Platform Webpage, or any page of either of LSAC LawPrepsm or the LawPrep Platform Webpage, is “framed,” surrounded, or obfuscated by any third party content, materials or branding. We reserve all of our rights under the law to insist that any link to LSAC LawPrepsm the LawPrep Platform Webpage be discontinued or removed, and to revoke your right to link to LSAC LawPrepsm the LawPrep Platform Webpage from any other platform at any time upon written notice to you.

Any reliance on the contents of a Linked Site is done at your own risk and you assume all responsibilities and consequences resulting from such reliance. Under no circumstances shall Pearson VUE or any of the Pearson VUE Service Partners be responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to you in connection with your use of, or reliance on, any content, goods or services available on any of the Linked Sites or any other third party website or platform. 15. ELECTRONIC COMMUNICATIONS.

When you access LSAC LawPrepsm or the LawPrep Platform Webpage, use or purchase any of our Products & Services or send e-mails to us, you are communicating with us electronically. In so doing, you consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on LSAC LawPrepsm or the LawPrep Platform Webpage. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.


16. INDEMNIFICATION.

To the fullest extent permitted by law, you agree to indemnify, defend and hold each of Pearson VUE and the Pearson VUE Service Partners harmless from and against any and all losses, damages, demands, claims, suits, judgments, costs, expenses, or other liability of any kind (including reasonable legal, accounting and expert fees, and expenses) suffered or incurred by Pearson VUE or any of the Pearson VUE Service Partners relating to, arising from, or resulting from your use of the Content (including LSAC/Pearson VUE Software) of LSAC LawPrepsm, including your violation of law or the rights of any third party thereto, or your actual, threatened or alleged direct or indirect breach of any of these LSAC LawPrepsm Terms. You further agree to advance each of Pearson VUE and the Pearson VUE Service Partners, upon demand, all costs and expenses (including reasonable legal, accounting and expert fees, and expenses) as they are incurred by Pearson VUE or any of the Pearson VUE Service Partners (as applicable) in connection with any matter covered by the indemnification provisions set forth in this Section 16.


17. EXPORT CONTROL OF SOFTWARE AND TECHNICAL DATA.

The following applies with respect to Software and other Content of a technical nature that you may obtain from LSAC LawPrepsm (other requirements set forth in these LSAC LawPrepsm Terms and certain additional terms and conditions may apply with respect to items offered for sale, purchased or sold): The United States of America controls the export of such intellectual property. You agree to comply with such restrictions and not to export or re-export the Content (including the Software) to countries or persons prohibited under the export control laws of the United States. By downloading the Content (including the Software), you are agreeing that you are not in a country where such export is prohibited and that you are not on the United States Commerce Department’s Table of Denial Orders or the United States of America’s Treasury Department’s list of Specially Designated Nationals. You are responsible for compliance with the laws of your local jurisdiction regarding the import, export, or re-export of the Software and/or other Content.


18. LOCAL STANDARDS.

We do not represent that Materials on LawPrepsm or the LawPrep Platform Webpage are appropriate for use in all locations. Persons who choose to access LawPrepsm or the LawPrep Platform Webpage do so of their own initiative and are responsible for compliance with any applicable local laws.


19. NO WAIVER.

Our failure to require or enforce strict performance by you of any provision of these LawPrepsm Terms or to exercise any right under these LawPrepsm Terms shall not be construed as a waiver or relinquishment to any extent of our right to assert or rely upon any such provision or right in that or any other instance.


20. SEVERABILITY.

Should any part of these LawPrepsm Terms be rendered or declared invalid by a court of competent jurisdiction, such provision shall be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law, and the remainder of these LawPrepsm Terms shall remain in full force and effect.


21. THIRD PARTY BENEFICIARIES.

Nothing in these LawPrepsm Terms shall be construed to give any rights to any third parties to enforce the terms hereof, except that each of the Pearson VUE Service Partners shall be an express third party beneficiary of, and entitled to enforce, the protections and rights bestowed upon such entity or person herein.


22. GOVERNING LAW AND JURISDICTION.

22.1 These LawPrepsm Terms shall be governed by and construed in accordance with the laws of India, without effect to any principles of conflict of laws.

22.2 Subject to the provisions relating to Dispute Resolution below, all disputes and differences of any kind whatsoever arising out of or in connection with these LawPrepsm Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi only, to the exclusion of all other courts/legal fora.


23. DISPUTE RESOLUTION.

Any and all disputes and/or differences that may arise as between you and Pearson VUE arising out of or in connection with or in relation to the LawPrepsm, the LawPrep Platform Webpage, Products & Services and/or the LawPrepsm Terms shall be exclusively submitted to arbitration under the Arbitration and Conciliation Act, 1996, as applicable, and shall be adjudicated by an arbitral tribunal comprising a sole arbitrator to be appointed by mutual consent of the parties. The arbitration shall be conducted in English language and the decision of the arbitral tribunal shall be final and binding on the parties. The seat of arbitration shall be New Delhi.


24. CLASS ACTION WAIVER.

YOU UNDERSTAND AND AGREE THAT ANY LEGAL ACTION OR PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE ACTION, UNLESS BOTH YOU AND PEARSON VUE SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE ACTION. THIS CLASS ACTION WAIVER IS NOT APPLICABLE TO THE EXTENT SUCH WAIVER IS PROHIBITED BY LAW.
